ONLINE BIDDING & CONDITIONS OF SALE

 

These conditions are to be read in conjunction with the ‘Buyers summary', found within our website. In bidding you accept these terms. Rosan & Company T/A Rosan Reeves Auctions.

1. Acceptance of all final highest bids is subject to approval by our client and Rosan Reeves Auctions reserves the right to reject any bids which they feel does not reflect reasonable value.

1.1 Rosan Reeves Auctions offers online bidding services as a convenience to its clients, but neither Rosan Reeves Auctions nor the seller will be responsible to you for errors during or after the sale or failures to execute bids, either live bids or absentee bids placed on the internet or on your mobile device, including, without limitation, errors or failures caused by:

(i) any loss of connection to the auction being conducted online;

(ii) a breakdown or problems with the online bidding software or the website service provider; and/or

(iii) a breakdown or problems with any internet connection, computer, mobile device, or system.

2. Access for bidding can be obtained through our website www.rosanreevesauctions.co.uk. or any hosting portal being used. Full details including valid email address must be provided in order to receive approval for bidding, in some cases we will require a refundable holding deposit, details will be listed prior to auction.

3. All lots are sold without warranty or guarantee and are "SOLD AS SEEN", and all buyers are encouraged to view prior to bidding. We are open for viewing Wednesday - Friday, via appointment only basis. 

4. VAT - Purchasers will be charged Value Added Tax on all lots, where applicable, at the current rates.

5. The purchaser will pay a Buyer’s Premium (BP) at a 20% rate plus VAT on each lot purchased and 15% plus VAT on Vehicle sales. BP is charged on all lots. The premium is not negotiable and will be paid by all buyers. VAT on BP is a UK service amount and payable in all instances including when goods may be exported.

6. Auction Sniping: In the event of a bid being received within 2 minutes of the scheduled closing time, the bidding period on that lot will automatically revert back to 2 minutes and will continue to extend with any bid received when there is below 2 minutes remaining. (IMPORTANT: When bidding, ensure to ‘REFRESH’ your screen so as you are aware of current bids).

7. Overseas Bidders should contact the office prior to bidding.

8. Payment Terms: All purchases are to be paid in full, no later than 48hrs after completion of auction sale. All queries regarding payment should be directed to our office team.

Successful bidders will be notified by email. 

Failure to make payment within 48hrs after the sale will result in your account being blocked and further action being taken.

9. Rosan Reeves Auction will only accept payment from and permit collection of lots purchased by the successful purchaser or their duly appointed agent.

10. Clearance Terms: All lots must be collected & removed from their location and as detailed in the auction listing or lot description. Clearance will be under the strict supervision of the Auction Staff, any person or persons found to be clearing goods without supervision will be asked to leave the premises. This is to safeguard all parties. Goods may be subject to storage & access charges if collected outside of the Clearance Terms.

11. Rosan Reeves Auctions does not undertake packaging, postage, delivery or shipment of goods (unless by prior expressed agreement) the bidder must make their own arrangements to comply with the clearance terms.

12. Clearance of all lots must be undertaken in accordance with Health & Safety at Work Regulations and, where necessary, Construction Design and Management Regulations 1994. You may be required to provide a Work Method Statement and Risk Assessment approved by Rosan Reeves Auctions, prior to removal of any lots. Rosan Reeves Auctions reserve the right to stop clearance if in their opinion, they believe it is being carried out in an unsafe manner or without the Method Statement and Risk Assessment.

13. Risk: The bidder/buyer is at risk once the buyer is notified of his successful purchases and is strongly advised to effect insurance at once, irrespective of whether title has passed. Title does not pass to the purchaser until payment has been received in full.

14. Photographs: The images shown on our auctions against certain lots, are representative only; they may not necessarily represent the actual lot item to be purchased.

15. All electrical items are sold as “Electrical Scrap” and should be “PAT” tested prior to use. No warranty or guarantee is given with any Lot regarding condition of quality/ functionality all electrical appliances are “sold as seen” the auctioneers cannot make any guarantees as to the condition or the safety of any lots wired for electricity. It is recommended that buyers have these items examined by a qualified electrical contractor before use.

16. MAILING: All approved bidders will automatically have their details placed on our database for notification of future sales undertaken by Rosan And Company. We do not sell or pass on details to any other party.

Please satisfy yourselves on all matters before bidding, ensure that you bid on the correct lot, and remember that all lots are sold as seen, quantities and description are for guidance only and should not be relied on. Also, whilst we believe that the goods are described working, faults are not declared and therefore no goods may be returned. We will make every effort to ensure the safe keeping of goods. However, we will not be held responsible for any damage or loss of goods once a sale has been declared. END

CONDITIONS OF SALE

1. Rosan Reeves Auctions decision on all matters to be final. No bidding to be retracted and we reserve the right to:

a) refuse any bid(s)

b) withdraw any lot from the auction at any time

c)put any lot up for auction again

d) The Auctioneer reserves the right to bid or refuse any bidding on behalf of the owners of any Lots comprised in the sale.

2. Rosan Reeves Auctions act as agents only, title to any lot at no time passes to the Auctioneers. Buyers acknowledges that a sale by auction IS NOT a consumer sale for the purposes of the Sale of Goods Act 1979 (as amended by the Sale and Supply of Goods Act 1994 and as replaced by the Consumer Rights Act 2015) and the Unfair Contract Terms Act 1977 / 1999 Regulations and the Buyer shall not seek to rely upon any conditions or warranties implied thereby or by any other legislation. All items/lots are sold “as is, where is” with no grading or guarantees irrespective of condition, wear, damage, and with all faults.” Each Lot as set out in the catalogue or as divided or joined with any Lot or Lots at the sale at the sole discretion of the Auctioneers is “SOLD AS SEEN” with all faults, imperfections and errors description and neither the vendor nor the Auctioneers are responsible for the authenticity attribution, genuineness, origin, authorship, date, age, period, condition or quality of any Lot, therefore a “NO REFUND POLICY” is in place. All statements listed online as to any of such matters are statements of opinion and are not to be taken as or as implying statements or representations of fact. Purchasers are deemed to have satisfied themselves by inspection or otherwise as to all such matters and as to the physical description of any Lot. Neither the Vendor nor the Auctioneers make or give nor has any person in the employment of the Auctioneers any authority to make or give any representation or warranty and in any event neither the Vendor nor the Auctioneers/ staff are responsible for any representation or warranty or for any statement listed online including verbal/written communication. 

3. Fitness for purpose and satisfactory quality.

The Seller does not make and does not agree to make any contractual promise, undertaking, obligation, guarantee, warranty, or representation of fact in relation to the satisfactory quality of the Lot or its fitness for any purpose.

The Seller will not be liable for any breach of any undertaking, whether implied by the Sale of Goods Act 1979 or otherwise, as to the satisfactory quality of the Lot or its fitness for any purpose. The Consumer Protection Act 1987: No lots are sold as new. 

4. Registration.

All bidders, users,  buyers must register with us before bidding. 

5. All conditions, notices, descriptions, statements and other matters listed online and elsewhere concerning any Lots are subject to any statements modifying or affecting the same made by Rosan Reeves Auctions. 

6. The Lots may be withdrawn, re-arranged or sold in any such order as may be desirable.

7. The Lot(s) will be at the entire risk of the purchasers after the fall of the hammer but in the event of the Lot(s) being totally missing on the day of delivery the Auctioneers will not be responsible for any estimated value beyond the price at which they were sold. In cases where portions of Lots may be missing, such missing portions are to be allowed for at an equitable proportion of the sum, for which the whole of such Lot was sold and no more.

8. The Auctioneers act throughout as “Agents” only and are not responsible for any default by the buyer. They disclaim liability for paying the Vendor until they have received settlement from the purchaser.

9. Any person on the Auctioneers premises before or after the sale shall deem to be there at their own risk and they shall have no claim against the Auctioneers in respect of any injury they may sustain or any accident which may occur. The Buyer shall be responsible to insure against and to make good any injury or damage to persons or property caused by the Buyer, their carriers, servants or agents, detaching, disconnecting or removing any goods purchased by the Buyer. The Buyer shall produce their insurance documentation to the Auctioneers on request. The Auctioneers reserve the right to stop the removal of a lot by a Buyer, his agents or employees, if it appears to the Auctioneers or its agents or employees that the removal is being carried out in an unsafe or unsatisfactory way. 

10. On failure of complying with the above Conditions, Any Lots not cleared by the time allowed may be resold by public or private sale and the deficiency (if any) together with all expenses attending such re-sale shall be made good by the defaulter at this present sale and shall be recoverable as liquidated damages. Any damage caused by removal or otherwise must be made good by the person committing the same. Principals will be considered responsible for the acts of their appointed removal personnel or other parties instructed by the principal.

11. Bidding online shall be deemed to indicate full and irrevocable acceptance of our terms and conditions.

12. Minimum Bid. 

All Lots for sale by public auction are subject to the Conditions of Sale listed above.

13. Payment for Goods.

Payments may be made by Online, Card or Bank Transfer

Failure to make payment within 48hrs after the sale will result in your account being blocked and further action being taken. 

14. Clearing of Lots

Lots purchased must be collect within 5 working days after the sale has completed, failure to collect within this time will result in your account being blocked and lots resold for the recovery of storage charges without reference to the purchaser. THERE WILL BE NO EXCEPTIONS.

15. Porters.

No goods are to be cleared until paid for and then only by an authorised porter and checked against a paid invoice. Goods must be cleared through the main doors. The porters responsibility is to check all lots removed are correct as detailed on the buyers invoice. Rosan Reeves Auctions will accept no liability for any damage caused during the removal of lots purchased. No member of the public is permitted into the clearing area at any time. 

Prosecutions will be undertaken against any one removing goods, which have not been paid for.

16. Sellers/ Vendors

 Auctions take place throughout the month, bank payments in settlement to vendors are forwarded within 14 days following the sale.

17. Buyers Premium.

Purchasers of all lots in the general sale will be charged buyers premium at 20% plus VAT. 

Purchasers of all motor vehicles / lots in the vehicles sale will be charged buyers premium at 15% plus VAT.

18. Shipping.

We currently do not offer a Shipping / Packaging service.

19. Reserves

Reserves may be placed on any items entered into the auction. 

THERE WILL BE NO EXCEPTION TO THESE CONDITIONS
